Liebe Kolleginnen und Kollegen,
manchmal lohnt es sich zu kämpfen. Dass dieser Satz – er mag zunächst wie ein banaler, abgedroschener Spruch klingen – seine Berechtigung hat, möchte ich mit diesem offenen Brief aufzeigen. Als Anbieter ambulanter und teilstationärer Pflege, der seit 25 Jahren als selbständiger Unternehmer auf dem Markt ist, wollte ich gegen den Pflegenotstand angehen. Als unsere Sozialstation eine hoffnungsvolle Initiative startete, wurden ihr sehr rasch von der Bürokratie Steine in den Weg gelegt. Dagegen haben wir uns entschieden gewehrt. Erfolgreich gewehrt, wie wir heute sagen dürfen.
Der Pflegenotstand ist schon längst in stationären Einrichtungen, Krankenhäusern, in der Kurzzeitpflege – aber vor allem in der ambulanten Pflege angekommen. Bundesweit werden monatlich zigtausend von Euro von ambulanten Pflegediensten in allen möglichen Medien verbrannt, um durch Stellenanzeigen an die erhofften Mitarbeiter/innen zu kommen. Viele von uns werben mittlerweile sogar im europäischen Ausland, um Pflegepersonal zu bekommen. Der Markt in Deutschland scheint inzwischen komplett ausgeschöpft.
Wo wollen denn Gesundheits- und Krankenschwestern/Pfleger und Altenfachkräfte nach ihrer Ausbildung am liebsten arbeiten? In erster Linie natürlich in den Bereichen, die sie kennen- und schätzen gelernt haben. Im Krankenhaus wäre das vielleicht auf einer Intensivstation, im Operationsbereich oder in einer Fachabteilung. In der Altenpflege tendieren viele in Richtung Beratung oder Beschäftigung. Die ambulante und teilstationäre Versorgung wird meiner Erfahrung nach eher als „Appendix“ angesehen.
Und jetzt stellen Sie sich einmal vor, Sie kommen als Inhaber eines ambulanten Pflegedienstes auf die Idee, künftig eigene Nachwuchskräfte auszubilden, auch mit dem Ziel, das Blickfeld für die ambulante Pflege zu schärfen. Vor einigen Jahren haben wir deshalb mit einer Altenpflegeschule Kontakt aufgenommen und vorgeschlagen, jedes Jahr gemeinsam einen kompletten Kurs mit 20 Altenpflegeschüler/innen auszubilden. Unsere Idee dabei war: Wenn 20 oder 30 Prozent der von ausgebildeten Schüler/innen nach der Ausbildung bei uns bleiben, können wir uns der Nachwuchssorgen mittelfristig vielleicht entledigen. Das eingesparte Geld für Vermittlungsprovisionen an Headhunter und die immensen Kosten für Zeitungsinserate können wir in eine fundierte Ausbildung einfließen lassen.
Eine Altenpflegeschule als Kooperationspartner war rasch gefunden. Ausrei-chend Bewerber auf dem Arbeitsmarkt gab es ebenfalls. Sollte das vielversprechende Projekt also reibungslos funktionieren? Wer die Bürokratie vieler Behörden kennt, ahnt bereits, was nun kommt.
Unsere Sozialstation hatte 2007, als wir das Ausbildungsprojekt starteten, 36 Pflegefachkräfte mit der Weiterbildung zum Praxisanleiter beschäftigt. Da die Senatsverwaltung für Soziales des Landes Berlin als vermeintlich (!) zuständige Behörde von einer 1:1-Betreuung zwischen Auszubildenden und Praxisanleitern ausgeht, bekamen wir auch nur 36 Ausbildungsstellen genehmigt. Nach dem ersten Jahr mit 20 Auszubildenden durften wir dementsprechend im zweiten Jahr nur noch 16 Auszubildende einstellen – und in dem darauf folgenden Jahr gar keine mehr. Intensiv haben wir mit der Berliner Senatsverwaltung diskutiert, haben unsere Argumente für einen anderen Anleiterschlüssel als 1:1 angebracht: Auszubildende sind schließlich häufig in der Schule zum theoretischen Unterricht. In der Zeit können sich Praxisanleiter um andere Auszubildende kümmern. Außerdem gibt es nachweislich in anderen Pflegebereichen, etwa in Krankenhäusern und Pflegeheimen, auch einen anderen Anleiterschlüssel.
Nach drei Jahren Rechtsstreit hat unsere Sozialstation einen Teilsieg bezüglich der Zulassung zur Altenpflegeausbildung errungen. Zwar wurde uns vom Verwaltungsgereicht Berlin kein Anleiterschlüssel von 4:1 zugestanden, wie eingeklagt, aber laut Urteil ist „die Klägerin … berechtigt, Altenpflege-schülerinnen und -schüler in einem Verhältnis von Schüler – Praxisanleiter von 2:1 auszubilden.“ Darüber hinaus wurde gerichtlich festgestellt, dass eine in Berlin früher getroffene Absprache von Senatsverwaltung, Altenpflegeschulen und Einrichtungsträgern, wonach der Anleiterschlüssel von 1:1 bestehe, „ersichtlich keinen normativen Charakter“ habe.
Im Jahr 2011 haben wir übrigens acht der bei uns ausgebildeten Altenpflege-fachkräfte für unseren Betrieb begeistern können. Sie alle haben ihre Ausbil-dung bestanden, zum Teil mit hervorragenden Noten. Die Praxisanleiter sind durchweg stolz auf ihre „Zöglinge“. Wir werden unseren eingeschlagenen Weg der Bekämpfung des Pflegenotstands gerichtlich gestärkt fortsetzen können. Eine Nachahmung dieses Projekts kann ich ausdrücklich empfehlen.
Manchmal, liebe Kolleginnen und Kollegen, lohnt es sich also tatsächlich zu kämpfen. Nicht unerwähnt möchte ich diesem Zusammenhang lassen, dass wir uns in dieser Angelegenheit alleine „durchgebissen“ haben. Allen diesbezüglich angeschriebenen Berufsverbänden war die Angelegenheit wohl nicht so bedeutsam, dass sie sich ihr hätten annehmen wollen („Einzelfallproblematik“).
Mein Rat: Lassen Sie sich doch öfter mal die Rechtsgrundlage erklären, nach der irgendwelche Bescheide erteilt werden. Und achten Sie verstärkt auf die Zuständigkeiten. In dem hier dargestellten Fall war die Berliner Senatsverwaltung für Gesundheit NICHT zuständig. Nach unseren Recherchen gibt es darüber hinaus in keinem Bundesland einen rechtskräftig verbindlichen Anleiterschlüssel für die Ausbildung.

ich bewundere ihre naheliegende und vollkommen plausible herangehensweise.
ich bin student der soziologie und von daher laie auf ihrem fachgebiet. aber in anderen gebieten kenne ich mich aus und dort würde ihre lösung vermutlich zum gleichen erfolg führen. aber auch in der wirtschaft oder der politik, der kunst und im sport, wird sich selten selbst um guten nachwuchs gekümmert und sich auch dort lieber verlassen auf andere, die es „schon richten“ werden und falls nicht, jammert man herum. peinlich sowas! und wie toll, dass menschen wie sie und ihr team darauf pfeifen und ein ungelöstes problem mal ganz anders (und daher in deutschland: mutig) angehen.
